Perforated Colon during Hernia repair..Is this malpractice? - colon hernia
Lap choly and I had a slipped disc. The surgeon stole my bowels 3 times and me and septic peritonitis. I wonder if this is considered professional misconduct. Those who had cancer of the cervix and injuries 13 years ago and had a hysterectomy. I also had a cesarean section 12 years ago. From what I have read, laparoscopic surgery was not attempted. Who knows whether this is a breach of the standard of care?

Yes, it is a breach of the standard of care. To have an abuse case, you must prove 4 elements. You have a duty to take what he was doing as your doctor. You need to prove breach of duty which is evident by the gross mismanagement of the operation. You must prove the loss occurred, in fact, if you think your show, peritonitis and sepsis was the direct result of the operation (it was).
